§ 9.02. FIREARMS AND OTHER DANGEROUS WEAPONS REGULATED . (Rep. & Recr. Ord. #16-95; Am. Ord. #7-11)

    DEFINITIONS. (Am. Ord. #4-96; Am. Ord. #15-11)

    (a)

    Weapon . Includes bow and arrow, crossbow, air gun, BB gun, sling shot, blow gun and other similar weapons, as well as those enumerated in §§175.60(1)(j) and 939.22(10), Wis. Stats., which are adopted by reference.

    (b)

    Firearm . A weapon which acts by force of gunpowder.

    (2)

    RESTRICTION ON USE OF FIREARMS AND OTHER WEAPONS. Firearms and other dangerous weapons shall be discharged within the Village only by the following persons, and only in compliance with the following standards:

    (a)

    Law enforcement personnel in the performance of their duties.

    (b)

    Persons who have registered to shoot under subsection (3) below and their designated invitees, or pursuant to a special registration under subsection (4) below. (Am. Ord. #21-08)

    (c)

    Hunting . (Cr. Ord. #20-13) The use of rifles for hunting within the Village is prohibited. Hunting within the Village shall be limited to bow, shotguns, muzzleloaders, handguns and rimfire rifle use only.

    (3)

    SHOOTING REGISTRATION.

    (a)

    Required . No person may discharge any firearm or other dangerous weapons in the Village without the landowner or designated invitee registering with the police department that shooting will be taking place on an identified property.

    (b)

    Registration . Registration to shoot shall be made by calling the police department or appearing in person to register. Registration shall include the following:

    1.

    An address of the property where shooting or hunting will take place.

    2.

    The person registering shall be the landowner or his/her designated invitee.

    3.

    The number of hunters and/or people shooting, (in accordance with Wisconsin Department of Natural Resources regulations) will be at the discretion of the landowner or their designee.

    4.

    Expiration date. All registrations shall expire on August 31 of each year.

    (c)

    Restricted Shooting Areas . (Am. Ord. #35-95) Except as provided in subsection (6) below, no registrations shall be issued for Sections 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35 and Wilderness Park as located in Section 12, all being in Town 9 North, Range 20 East, in the Village.

    (d)

    Shooting Regulations .

    1.

    The discharge of firearms shall be limited pursuant to Wisconsin Department of Natural Resources regulations.

    2.

    It shall be unlawful for any person to discharge a firearm or other dangerous weapon within the Village in a careless and negligent manner and without due caution, or in willful or wanton disregard for safety, so as to endanger or be likely to endanger property or any person.

    3.

    It shall be unlawful for any person other than a police officer in the performance of official duties to use or discharge a firearm or other dangerous weapon:

    a.

    Within 300 feet of a building devoted to human occupancy without the permission of the owner or occupant. The term "building," as used in this subsection, shall not include a tent, bus, truck, recreational vehicles, or similar portable unit.

    b.

    Within any Village park or other land owned by the Village.

    c.

    Within any publicly owned land except as expressly allowed and duly authorized by state law.

    4.

    In no case shall a firearm or other dangerous weapon be discharged in a direction that could result in the projectile landing on or flying over any adjacent property parcel unless the owner of such adjacent property has given written permission to do so.

    (4)

    SPECIAL REGISTRATION. (Am. Ord. #21-08) Special registration for the preservation of crops or target shooting may be granted by the Police Chief or his designee.

    (5)

    LIABILITY NOT ASSUMED. The Village does not assume any liability for damages to persons or property caused by the discharge of firearms or other dangerous weapons.

    (6)

    PENALTY. Any person who shall violate any provision of this section shall be subject to a penalty as provided in section 25.04 of this Code.
