§ 12.25. BLOCK PARTY PERMIT REQUIRED. (Cr. Ord. #16-93)

    DEFINITION. A block party is a gathering of abutting neighbors and their relatives and friends or special church sponsored events held within the Village street right-of-way or other public thoroughfare which has been temporarily closed for the occasion.

    (2)

    PROHIBITION. No person shall encroach upon, occupy, obstruct or encumber any public street or highway, or part thereof, for the purpose of participating in a block party unless authorized to do so in accordance with this section.

    (3)

    STREET CLOSING FOR NEIGHBORHOOD BLOCK PARTIES. Upon application by a resident of the affected portion of the street, the Village Clerk may grant a permit to close a definite and limited portion of a street in the Village for a neighborhood block party. No such permit shall be granted in the event that:

    (a)

    The street sought to be closed, or portion thereof, is a part of the Federal, State or County trunk highway system or is a major through street.

    (b)

    Such closure will, will be likely to, or will tend to cause unreasonable traffic congestion, result in a disturbance of the peace, or endanger the public health, welfare and safety.

    (c)

    Access to a business place would be disrupted.

    (4)

    APPLICATION FOR BLOCK PARTY PERMIT.

    (a)

    Application for a block party permit shall be made not less than 15 working days in advance of the event on a form to be provided by the Village Clerk.

    (b)

    In the event that any person who resides or conducts business in the blocked-off portion of the street objects to such closing, the application for the permit may be denied.

    (5)

    FEE. (Am. Ord. #9-96) The block party permit fee is $25.00 and shall accompany the application.

    (6)

    RESPONSIBILITIES OF PERMITTEE.

    (a)

    Acceptance of a permit shall make the applicant primarily liable for damages to persons or property caused by reason of the closing. The Village shall not be liable for any damage caused by the street closing.

    (b)

    Permittees shall be responsible for making arrangements with the Director of Public Works to procure the barricades used to close the streets. No block party shall commence or continue unless barricades are properly placed and maintained.

    (c)

    Music or noise must be kept at a reasonable level so as not to disturb others. Amplified noise or music is prohibited at block events.

    (7)

    HOURS. Block parties shall start no earlier than 10:00 a.m. and end no later than 8:30 p.m.
