§ 12.181. TEMPORARY ROCK CRUSHING AND BLASTING PERMIT. (Cr. Ord. #12-97)

    PERMIT REQUIRED. No person shall mine or extract rock without first obtaining a conditional use permit issued pursuant to sections 17.36 and 17.42 of this Code and a mining operation permit pursuant to section 12.18 of this chapter or a temporary rock crushing and blasting permit from the Director of Public Works pursuant to this section.

    (2)

    APPLICATION AND FEE. Application for a permit shall be made on forms provided by the Director of Public Works and shall be accompanied by a fee of $50.00.

    (3)

    TERM OF PERMIT. The permit shall expire 90 days from the date of issuance unless lesser or greater time is approved.

    (4)

    RESTRICTIONS AND OPERATION RULES.

    (a)

    All blasting shall be under the supervision of a person holding a Class 3 blaster license as provided in Wis. Adm. Code COMM 5.20.

    (b)

    Only on-site rock may be crushed and all crushed aggregate used on site for backfilling trenches, road construction and berming.

    (c)

    The crusher shall be located at least 200 feet from any exterior property line.

    (d)

    The hours of operation shall be 8:00 a.m. to 5:00 p.m. Monday through Friday, but excluding holidays.

    (e)

    All off-site trucking of excess uncrushed rock shall be completed prior to the expiration of the permit.

    (f)

    The Director of Public Works may impose additional restrictions as he deems necessary.

    (5)

    PENALTY. Any person who violates any provision of this section shall be subject to a forfeiture as provided in section 25.04 of this Code. A separate offense shall be deemed committed on each day on which a violation of this section occurs.
